Race '07-1' Request for Redress by M Sloop#MR 38 Rick Brown For Race Committee# status 'Allowed'

Facts Found:
1. T12, OG175, and MR38 were scored 11th, 12th and 13th.
2. The finish sheet provided by the scorer listed T12, OG175 and MR38 in a column for a different class, while the rest of the fleet was listed in the correct column.
3. The scorer was unable to reconcile the finish sheet with the recorder to properly determine T12, OG175 and MR38's finishes.
Conclusions:
1. The RC erred by improperly recording the finishes for T12, OG175 and MR38.
2. Through no fault of their own, the error made the finishing positions of T12, OG175 and MR38 significantly worse.
3. MR38 is therefore entitled to redress.
4. As the finishing positions of MR38, T12 and OG175 cannot be reliably determined, the PC orders the race to be abandoned.
Race '07-2' Protest by Marshal Sandpiper#SA4 Cat Bird/Roland Gehweiler/Bill Donohue Against Marshal Sandpiper#BH42 Ed King status 'Allowed'

- This protest will be heard Thursday evening at Metedeconk river Yacht Club no later than 2030 (8:30pm).

Facts Found:
1. Approaching the finish line, SA 4 is overlapped to leeward of BH 42 at the 3 boat length zone of the committee boat.
2. SA 4 and BH 42 head up to cross the finish line.
3. BH 42 was within 2-3 feet of the committee boat.
4. As SA 4 and BH 42 crossed the finish line, SA 4 bore away to attempt to avoid a collision with BH 42.
5. After crossing the line, but before clearing it, SA 4 and BH 42 made contact. There was no damage.
Conclusions:
1. SA 4 was required to give mark room at the committee boat to BH 42 per 18.2b.
2. The boats had finished, but were still racing when contact was made, as they had not cleared the finish line (definition of Finish, definition of Racing, Appeal 16).
3. Although BH 42 is give way boat per RRS 11, SA 4 altered course in such a way that BH 42 could not keep clear, as BH 42 was taking mark room she was entitled to at the committee boat.
4. SA 4 therefore breaks RRS 16 and is therefore to be scored DSQ.
Race '08-1' Protest by A Cat#MC-R Raven Against A Cat#lb Lightning status 'Allowed'

- This protest will be heard at 0730 on Saturday 7/24/2010 at Shore Acres Yacht Club.
- Decision:

Facts Found:
1. The wind was 10-12kts from the west, the sea was calm.
2. Witch and Raven were on the layline approaching the the windward mark on starboard tack within the 3 boat length zone at approximately 6kts.
3. Raven trailed Witch by approximately 1 1/2 boat lenghts.
4. Lighting, on port, was approaching the starboard layline, attempting to cross between Raven and Witch.
5. Lighting starts to cross behind Witch within a half boat length of Witch's stern.
6. As Lightning crosses Raven's bow, Raven alters course to avoid, first slightly to windward, and then hard to leeward to duck Lighting's stern.
7. Lightning continues on port past Raven and Witch before tacking to starboard.
Conclusions.
1. Lightning as the port tack boat is required by RRS 10 to keep clear of Raven and Witch.
2. Raven had a reasonable expectation that contact would occur had she not alter her course , and per RRS 14, altered course to avoid contact.
3. Lightning breaks RRS 10 is therefor to be scored DSQ.

Facts Found:
1. SI 11.5 states that "no warning signal will be made after 1530"..
2. A warning signal for Race 1 for the Ensign class was made at 1541, with a start at 1546.
3. The race proceeded for approximately 25 minutes when the RC abandoned the race.
4. The winds were light to nonexistent at the time of the abandonment, and was variable in direction.
Conclusions:
1. The RC improperly started the Race 1 in violation of SI 11.5.
2. The RC considered both the wind conditions and the fairness of the race with respect to starting beyond the stated time limit, and therefore acted properly in abandoning the race.
3. The requirements for redress are not met, therefore redress is denied.

1. At the start, LA 50 was OCS, and was identified by the line officer as being OCS.
2. Within 5 seconds of the start signal, the individual recall flag was raised, with a sound.
3. The individual recall flag remained up for four minutes.
4. LA 50 did not return to the pre-course side and start properly.
5. LA 50 was scored OCS for the race.
Conclusions:
1. The RC displayed the individual recall flag in a timely manner (see ISAF Case 79).
2. As the individual recall flag was displayed timely, the RC did not commit an error or omission in displaying the flag.
3. LA 50 does not meet the requirements for redress, therefore redress is denied.
